PRIVACY POLICY FOR VECMAP® MOBILE COMPONENT

This privacy policy describes the collection of personal data through the VECMAP® Mobile component (‘Application’) on your mobile device and informs you about the use of such personal data.

The Application is part of Avia-GIS’ VECMAP® product, which is the one-stop-shop for risk mapping. VECMAP® automates and optimizes the complex task of mapping presence of species and tracking their progress, and makes it possible to design strategies to contain them and manage the risks they pose.

The Application can only be used in connection with a VECMAP® license granted by Avia-GIS to an Avia-GIS customer (‘Customer’). You will be provided credentials by the Customer to login on the Application.

The Application mainly allows for, and assists in, the collection of certain species related information you observe in the field (‘Field Work’) and the transfer of such information for further use and processing by Customer in VECMAP®.

By installing the Application and by continuing your use of the Application, you grant your unambiguous consent to the collection and processing of data as described below.

Please be aware that you may not use the Application if you are under sixteen (16) years of age.

A. Data collected through the Application

Personal data is information which identifies you as an individual, whether directly or indirectly through the combination with other information held by Avia-GIS.

In order for you to download and use the Application, Avia-GIS requires you to provide the login information you received from the Customer and your confirmation on the age restriction.

During the installation process, the Application will also request access to your camera and photo gallery to allow you to store in the Application photos you have made during Field Work. The Application further requests access to read and write external storage on your device to be able to export data files from the Application to your device.

The Application will collect your device’s IP address, the Application installation ID (Visual Studio App Center) and your real-time location (coordinate location and orientation) based on information provided by your device operating system (‘OS’).

The Application also contains Customer defined information fields, where the Customer may request you to provide certain personal data.

Avia-GIS may also collect non-personal data for the purposes of diagnostics and analytics.

Avia-GIS collects non-personal data that does not directly or in combination with other information identify you as an individual. The non-personal data collected by Avia-GIS may be your type of device, type of OS and information on your use of the Application.

B. Purpose of collection and use of information

Avia-GIS collects and uses personal data for the following specific purposes:

to transfer such information collected in the Application to the VECMAP® services used by Customer which provided you with your login credentials
to provide you with navigational services, including an overview of your current location on a map, to facilitate your Field Work
to make anonymized data available in VECMAP® SmartCloud, provided the Customer has opted-in for such use of data
to provide support and send you adequate information regarding the Application
for Avia-GIS’ diagnostics, analytics and product improvement
to investigate potentially unlawful use of the Application

To the extent personal data is subject to the General Data Protection Regulation (EU) 2016/679 (‘GDPR’), the Customer qualifies as the controller of the processing of personal data under section a) above and Avia-GIS qualifies as a processor. For sections b) through f), Avia-GIS acts as the controller of the processing of personal data that falls under the scope of the GDPR.

Non-personal data is used for diagnostics and analytics and to improve the Application.

C. Third party recipients

Avia-GIS may disclose your personal data to the following third party recipients:

Avia-GIS’ service providers, including its IT service providers, hosting providers (including Amazon Web Services and Microsoft), and providers of data analysis
Other recipients based on Avia-GIS’ legitimate interests as permitted under applicable law
Third parties as required by mandatory law, to comply with legal procedures, to respond to requests from public authorities, to enforce this policy and to protect Avia-GIS’s rights
A third party in the event of any merger, sale or transfer or other disposition of all or any portion of Avia-GIS’ business in which said third party is involved

Transfers only relate to personal data which is adequate, relevant and limited to what is necessary in relation to the purpose for which it is transferred. Avia-GIS will require each such third party recipient to provide equal protection to your data as stated in this privacy policy and as required by the guidelines of the platform from which the Application can be downloaded.

Other than as set forth above, Avia-GIS will not transfer any of your personal data to third parties without your explicit consent.

D. Security, reliability, processing locations and retention

Security

Avia-GIS has implemented appropriate technical and organizational measures (including encryption and pseudonymization), which are designed to implement data-protection principles in an effective manner and integrated the necessary safeguards into the processing in order to protect information against accidental or unlawful destruction, loss, alteration, unauthorized disclosure of or access to personal data, and against all other unlawful forms of processing.

Reliability

Avia-GIS takes reasonable steps to ensure that any personal data in its possession is accurate, current and reliable for the purposes set out above.

Processing locations

Personal data collected through the Application will be stored and processed on your device, in the European Economic Area (‘EEA’) and, where the Customer acts as the controller of personal data processing, in other locations chosen by the Customer.

Retention

Personal data in Avia-GIS’ possession or control will be deleted within thirty (30) days after expiration of the Customer’s VECMAP® license or when Avia-GIS is so instructed by the Customer. The Customer may also delete through the VECMAP® services certain personal data at its own discretion.

Provided that the Customer has opted-in for contribution of data to VECMAP®’s SmartCloud, anonymized data will be retained as part of VECMAP®’s SmartCloud for as long as they provide a valuable contribution to the improvement of modeling to Avia-GIS customers.

Analytics and diagnostics data is kept for a maximum of ninety (90) days after which it is deleted.

E. Your rights

In respect of the collection and use of your personal data, you may

ask Avia-GIS whether it processes personal data about you, for which purposes, the categories of personal data concerned, to which recipients the information has been disclosed, where possible, the envisaged period for which the personal data will be stored (or, if not possible, the criteria used to determine that period)
inquire with Avia-GIS about the appropriate safeguards relating to the transfer to a third country (if applicable)
ask Avia-GIS a copy of the personal data undergoing processing (including for data portability purposes) and have it rectified
object against the further processing and request erasure of your personal data on legitimate grounds
request that the processing of your personal data is restricted by Avia-GIS
request not to be subject to a decision based solely on automated processing, including profiling, which produces legal effects concerning you or similarly significantly affects you

In order to do so, you should send Avia-GIS an e-mail at privacy@avia-gis.com with sufficient proof of your identity. Avia-GIS will undertake the necessary action without undue delay and provide information on action taken (or the absence of any such action) within thirty (30) days.

You may also lodge a complaint with a supervisory authority in case of breach of the applicable privacy laws by Avia-GIS.

You may at any time immediately stop any collection and processing of personal data by Avia-GIS by uninstalling or deleting the Application. Uninstalling the Application will also delete all information collected through the Application that is stored on your device except for photos made by your camera that are stored locally on your device. Uninstalling the Application will not delete the information that was already transferred by the Application to the Customer’s VECMAP® service.
